What punishment is currently given for drugs in Belarus?

Consumers have a good chance to get probation, while dealers almost always get a penal colony.

In the first half of 2026, 1039 people were convicted in Belarus for crimes related to illicit drug trafficking (Articles 327-331, 332 of the Criminal Code). This accounts for 8.2% of all convicted persons in the country, according to the Supreme Court.

At the same time, the number of people convicted for drug offenses is decreasing. The number of convictions was 4.9% lower than in the same period of 2025.

The situation is divided into two fundamentally different parts: those convicted for possession "without intent to sell" (consumption, Part 1 of Article 328), and those found guilty of selling (Parts 2-5 of Article 328).

For consumption — more often "chemistry" (restriction of freedom)

Under Part 1 of Article 328 of the Criminal Code, 666 people were convicted. Here, the punishments are noticeably milder.

Most consumers — 467 people (70.1%) — were sentenced to restriction of freedom, known as "chemistry" (probation/correctional labor). This figure includes both "chemistry" with referral to an open-type institution and home "chemistry" (house arrest).

69 people, or 10.4%, were sent to a penal colony.

Another 31 people (4.7%) received arrest, one was fined, and 98 people (14.7%) received other measures — deferment, conditional non-application of punishment, or conviction without sentencing.

Among those convicted for consumption were 8 minors (last year — 13). Seven of them received "chemistry," and one received a deferment. None of the teenagers ended up in a penal colony for consumption.

For selling — almost always a penal colony

A completely different logic applies to those convicted for selling drugs (Parts 2-5 of Article 328 of the Criminal Code). There were 314 such people.

Here, 295 people — 93.9% — received real deprivation of liberty. Only 19 people (6.1%) were sentenced to restriction of freedom. 10 of them remained on home "chemistry," and 9 were referred to an open-type institution.
