Such conclusions require a specific evidentiary basis, and at the moment, Karim Khan does not see it.

International Criminal Court Chief Prosecutor Karim Khan currently sees insufficient evidence of genocide by Israel in the Gaza Strip. He stated this in an interview, Bild writes.
Earlier, Khan requested arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant on suspicion of war crimes and crimes against humanity, but he consciously refrained from charges of genocide.
In a conversation with British-American journalist Mehdi Hasan, Khan explained his decision. He emphasized that prosecutors should not act under the influence of political slogans or public pressure, but must rely solely on evidence.
Hasan pointed out that many experts, as well as his predecessor Luis Moreno Ocampo, already refer to Israel's actions in the war as genocide. However, Khan made it clear that the ICC needs a specific evidentiary basis for such conclusions — and at the moment, he does not see it.
"A prosecutor who acts only under the pressure of public opinion would be a reckless prosecutor. Decisions are made based on evidence," he said, and added, "The investigation is not over. It is ongoing."
The prosecutor also referred to the case against Putin: he compared it to the court's actions regarding Russia in connection with the war in Ukraine. According to Khan, the international court "first requested arrest warrants in the case of the deportation of Ukrainian children, and later initiated additional proceedings related to attacks on civilian infrastructure."
Khan believes that the investigation into Gaza could develop similarly. At the same time, in the interview, he emphasized the scale of suffering of the civilian population and stated that his office continues to work on the investigation.
