Trump added another 10% tariffs on all imports after previous duties were deemed illegal

During a press briefing at the White House on February 20, Trump stated that he would not abandon his tariff policy and would sign an executive order to introduce 10-percent global tariffs in accordance with Section 122 of the Trade Act of 1974 — in addition to existing tariffs.

Earlier on February 20, the US Supreme Court, by a 6-to-3 vote, overturned the massive import duties imposed by Trump under the International Emergency Economic Powers Act (IEEPA) of 1977. The Court ruled that the US Constitution clearly grants the right to impose taxes and duties to Congress, not the president. Chief Justice John Roberts emphasized that the framers of the Constitution did not empower the executive branch to unilaterally impose tariffs.

Trump, however, stated that the court's decision only affected a specific use of IEEPA and that he still had other legal mechanisms to impose duties.

"Therefore, effective immediately, all national security tariffs under Section 232 and existing Section 301 tariffs... remain in place, in full force and effect," the US president said.

His administration also plans to initiate new investigations under Section 301 to combat "unfair trade practices."

Among the alternative tools available to the US president, Sections 301 and 122 of the Trade Act of 1974 are considered key. Section 301 allows for retaliatory measures after an investigation into trade violations by other countries, but the procedure can take up to a year, limiting the speed of action. Section 122 allows for the quick imposition of temporary import surcharges of up to 15% or quotas, but for no more than 150 days without congressional approval.

US Treasury Secretary Scott Besent has already acknowledged that these alternative mechanisms are less powerful and effective than using emergency powers under IEEPA.

According to polls, tariff policy does not enjoy broad support among US voters, who are more concerned about rising prices and goods availability. However, Trump has repeatedly stated that this issue is fundamental to his economic program.
