Minsk resident with a mental disorder bequeathed two Minsk apartments to a ministry
The man suffered from alcoholism and a mental disorder. Therefore, his cousin tried to have the will declared invalid through court, but the court sided with the ministry, Minsk-News reports .
The man died in January 2024. After his death, two apartments in Minsk remained. Two years before his death, he formalized a will with a notary, according to which the property was to be transferred to an unnamed ministry.
The deceased's cousin applied to the notary for acceptance of the inheritance on July 30, 2025. After that, she turned to the court.
According to the woman, at the time of drawing up the will, the man was unable to understand the meaning of his actions and control them — he suffered from mental illnesses and alcohol addiction.
A posthumous comprehensive psychological and psychiatric examination confirmed that the man had these illnesses. However, experts could not determine whether they affected his ability to understand his actions precisely at the moment of signing the will.
At the same time, the expert stated in court that such an illness, by itself, usually does not mean a person's inability to understand their actions. The doctor, neighbors, and notary also testified that the man was of clear mind during that period.
The court denied the sister's request to declare the will invalid.
Simultaneously, the court granted the ministry's request to recognize it as the heir. According to the court, representatives of the institution were unaware of the inheritance until the notary sent them a corresponding notification. They received this notification only on September 12, 2025. Therefore, the court recognized the reason for missing the six-month period for accepting the inheritance as valid.
As a result, the court recognized the ministry's right of ownership by will to both Minsk apartments.
