In Gomel, authorities illegally sold an apartment belonging to a large family
A two-room apartment belonging to a large family was put up for auction by mistake — the deal may be annulled, writes "Belka".
The family bought housing in an agrotown near Gomel with the involvement of family capital. Over time, the mother of five children accumulated large debts. To repay them, the apartment was put up for auction and found its buyer.
However, when the new owner wanted to register the right of ownership to the housing with the state agency, he was refused. It turned out that the apartment is subject to alienation restrictions until 2027.
“According to the law, real estate purchased with family capital funds belongs in equal shares to all family members. This means that the debtor does not own the largest share there, and therefore, the entire apartment could not be put up for auction,” explained Natalya Kapitanava, senior assistant prosecutor of Gomel.
The buyer appealed to the prosecutor's office for the protection of his rights. Measures will also be taken to protect the interests of the debtor's minor children. How the situation will be resolved is not reported.
