After the fall, the victim felt severe pain in her left shoulder area; she was taken by ambulance to a trauma center.
A forensic medical examination established that the girl had a closed fracture of the scapular end of her left clavicle, as well as bruises and scratches.
During the investigation, it was revealed that the incident was caused by the actions of a 14-year-old teenager. He was moving down an adjacent escalator and, upon seeing acquaintances riding up, grabbed one of them by the neck as a greeting. The boy, startled, lost his balance and began to fall, knocking the girl down as well.
The victim filed a lawsuit with the Leninsky District Court of Mogilev, seeking compensation for moral damages from the teenager, his legal representatives, and also from the owner of the escalator. She noted that she had been on sick leave for a long time, unable to fully study or work on her diploma, as she was a final-year student. She estimated the amount of moral damages at 25 thousand rubles.
After reviewing the case materials, the court concluded that the fall was precisely due to the careless actions of the teenager who grabbed his acquaintance by the neck. As a result, it was decided to recover 7 thousand rubles in compensation for moral damages from him in favor of the girl, or from his legal representatives if he had no income himself.
