A Belarusian doctor and her family went to a village more than 200 kilometers from home, expecting to spend her entire 21-day vacation there. But after a week, she received a call from work: a patient had complained about the woman, so she was demanded to come within two days and write an explanatory note. Whether this is legal was explained by the trade union of the newspaper "Gomel Pravda".
The complaint concerned a situation that occurred even before her vacation. The patient asked for a sick leave, but the doctor refused: in her opinion, there were no medical indications for it.
When the woman was already on vacation, a HR department employee called her and demanded she return. In case of refusal, the doctor was warned about possible disciplinary action and the drawing up of an act stating that she had not provided explanations.
However, by law, the woman is not obliged to interrupt her vacation for a trip to work.
Sergei Khurbatov, the chief legal labor inspector of the Gomel Regional Organization of the Belarusian Trade Union of Healthcare Workers, explained that during vacation, an employee is exempt from work duties. Therefore, an explanatory note can be written upon return — on the first working day.
However, vacation itself does not protect against disciplinary action if the violation was committed before its start. Vacation days are not included in the one-month period from the day the offense is discovered, during which the employer can apply the penalty.
