Minsker rented out an apartment to "lawyer Andrey" and for ten months cannot evict the non-payer
Minsker Maria Ivanovna had rented out her one-room apartment on Syalitskaya Street in Shabany for 15 years and never had problems with tenants. But last year, a man who introduced himself as a lawyer moved into her home. As a result, the owner has not received rent for ten months and cannot even enter her own apartment, writes "Onliner".
After renovations, the woman and her daughter listed the apartment for rent for 850 rubles a month plus utility payments. The first potential tenant was a woman who said she would live with her husband, child, and cat. She assured them that there would be no problems with payment, as her husband works as a lawyer.
When finalizing the contract at the housing office, it turned out that the couple was not officially married. Despite her doubts, Maria Ivanovna signed a one-year contract with Andrey. Initially, he paid on time, but after a few months, he stopped. First, he promised to pay after his financial situation improved, and then he stopped communicating altogether.
When the owner and her daughter arrived at the apartment, no one opened the door. They had to call the police. It turned out that the tenants were inside. The apartment had become dirty during this time, it was smoked in, and the door was damaged. According to the owner, neighbors had also repeatedly called the police due to the residents' behavior.
Maria Ivanovna contacted a lawyer and officially notified the tenants about the termination of the contract. However, they refused to move out. In April, the woman filed a lawsuit in court.
The court sided with her: the contract was terminated, and Andrey was ordered to pay 9525 rubles - arrears for rent and utilities, as well as court costs. But even after this, the man did not leave the apartment.
At the end of June, the owner demanded that he leave the dwelling with his cohabitant and her child. Andrey replied that he was not yet ready to move out. As a result, they continued to live in the apartment until the end of August, although the contract had already been terminated.
Maria Ivanovna contacted the district police officer and the police. She was advised to go to court again - this time with a demand for eviction. She also handed over the documents after the first decision to the bailiffs, but the situation did not change quickly.
Moreover, the owner tried to change the locks. She paid more than 500 rubles for the work, but in her absence, the lock was replaced again, and the woman completely lost access to her own home.
According to Maria Ivanovna, Andrey already has another case regarding debt to another landlord in Minsk. There he allegedly also owes about 6000 rubles.
The tenant himself claims that he did not "seize" the apartment and promises to move out by the end of August. To the owner's questions about the debt, he replies that he will definitely pay, but does not specify exact deadlines.
