The price of one trip: a girl who hit a pensioner with a scooter was sentenced in Gomel. How was she punished?

Last August, around noon, a girl, returning home after cosmetic procedures, decided to use an electric scooter rental service. The girl rented a scooter on Osipova Street, planning to ride home. However, instead of moving on the sidewalk or bike path, as required by the Road Traffic Regulations, she rode onto the roadway, write "Gomel News".

Moving along Narodnogo Opolcheniya Street, the girl approached an unregulated pedestrian crossing. At that moment, a woman began crossing the road at the "zebra" crossing. According to the accused herself, she decided not to brake, but to go around her from the left. However, the pedestrian took a step in the same direction, and a collision could not be avoided.

Both fell from the impact. As a result, the pensioner sustained serious injuries: a fracture of a bone in her right foot, a torn wrist wound, and a hematoma in the occipital region. Medical examination classified these injuries as less severe — treatment lasted more than four months.

The culprit did not deny her guilt, but the amount of compensation for the physical and moral suffering of the victim caused disputes.

Immediately after the incident, the girl did not flee the scene of the accident. Together with a passerby, she helped the victim get up and accompanied her home. The girl left her contacts, and later that day, at the victim's request, bought the necessary medicines.

The victim soon felt worse and called an ambulance, after which medical workers reported the incident to the police.

The court established that at the time of the accident, the scooter was technically sound, the weather was clear (visibility was 30 kilometers), and the girl herself was sober. In court, the Gomel resident fully admitted her guilt and repented of what she had done.

Court decision

The court found the girl guilty under Part 1 of Art. 321 of the Criminal Code (violation by a road user of traffic safety rules, which negligently caused less severe bodily injury).

When determining the punishment, positive characteristics and assistance to the victim immediately after the accident were taken into account.

Final penalties:

fine: 70 basic units (3150 rubles);

moral damages: 5000 rubles in favor of the victim;

state duty: 135 rubles.

The question of compensation for material damage (730 rubles) will be resolved in separate civil proceedings.

Until the verdict comes into force, the girl remains under a written undertaking not to leave the country.
