In Lida, a grandmother gifted an apartment to her granddaughter, and later reclaimed it through court
In Lida, an 87-year-old pensioner successfully reclaimed an apartment through court that she had previously gifted to her granddaughter, without understanding the true meaning of the signed documents, writes Domovita.by.

The story began in March 2022, when the elderly woman visited a local state registration agency. She was convinced that she was signing a rent agreement or a care agreement. However, in reality, it was a deed of gift, according to which her only apartment was transferred to her granddaughter's ownership.
Moreover, back in 2019, the grandmother had drawn up a will in favor of her granddaughter, according to which the latter was already supposed to receive the apartment after her death. However, the granddaughter decided not to wait and persuaded her grandmother to sign documents that she believed were related to arranging care for her.
For the next three years, the granddaughter helped her elderly relative, and the grandmother was unaware that she had already lost ownership of her home. The situation changed in May 2025, when the granddaughter suddenly stopped visiting and caring for her grandmother.
After this, the pensioner sought legal assistance from the Lida Legal Aid Office. Upon examining the documents, it was revealed that the apartment had been gifted back in 2022.
The lawyers prepared a lawsuit and applied to the Lida District Court with a demand to declare the deed of gift invalid. Medical documents regarding the woman's health condition were submitted as evidence, along with witness testimonies confirming that due to her age and health problems, she did not understand the essence of the signed papers.
The granddaughter's side attempted to dispute the claims, citing that more than three years had passed since the transaction was concluded in 2022, and the statute of limitations had allegedly expired. However, the court did not accept this argument. According to the law, the countdown for the term begins from the moment a person learns about the violation of their rights. In this case, the pensioner only realized what had happened in the summer of 2025, when her granddaughter stopped caring for her.
As a result, the Lida District Court satisfied the pensioner's demands and annulled the deed of gift. The granddaughter tried to appeal the decision, but the appellate instance upheld it without changes. Thus, the apartment was returned to the ownership of its 87-year-old owner.
