European Commission: appointment of new members of the Constitutional Tribunal falls within the powers of the Sejm
Poland must ensure the functioning of the Constitutional Tribunal according to the constitution and decisions of European courts — the European Commission stated that it is closely monitoring the crisis around Poland's Constitutional Tribunal. The conflict escalated after clashes near the court building on Friday evening, Euronews reports.
“It is the duty of the Polish authorities to ensure the functioning of the Constitutional Tribunal in accordance with the Polish constitution and taking into account the relevant practice of the Court of Justice of the European Union,” a representative of the European Commission informed in response to an inquiry from Euronews.
He also emphasized that the appointment of eight new members of the tribunal belongs to the constitutional powers of the Sejm.
Separately, the commission's representative mentioned the decision of the European Court of Human Rights from May 5, 2026. The Court adopted interim measures, obliging Polish authorities not to obstruct the assumption of office and work of judges appointed by the Sejm in March.
Tusk's government explains its actions by the need to restore the rule of law after years of interference by the "Law and Justice" party in the judicial system. The opposition, in turn, accuses the government of an attempted coup.
