White House Prepares to Act Without Congress's Consent if Democrats Win Elections

Donald Trump's team has been developing solutions for several months in the areas of immigration, tariffs, housing, and budget expenditures, which the president will be able to adopt independently. Simultaneously, officials are being prepared for potential Congressional investigations, reports Reuters , citing sources.

Preparation has been underway since April. It involves Deputy White House Chief of Staff Stephen Miller, Budget Director Russell Vought, and lawyers for the US president.

According to one official, lawyers are examining «what Trump can legally do on his own, where he could test the limits of his powers, and how to defend these decisions in court.»

Trump is aware of the preparations and participates in their discussion.

When asked how comfortable he would be governing with Congress under Democratic control, one source replied: «Very comfortable.»

The midterm elections will take place on Tuesday, November 3rd. Polls favor Democrats in the race for the House of Representatives, while the outcome of the Senate elections is still impossible to predict.

What Decisions Are Being Prepared

According to Reuters sources, the administration is considering new tariffs on the import of critical minerals and wind turbines, stricter visa rules for foreign students and temporary workers, as well as measures to reduce housing and construction costs.

Federal agencies have already submitted their proposals and legal assessments of what can be done without Congress's consent.

Officially, the White House has rejected the scenario of a Republican defeat and accused the media of promoting a false narrative.

What Democrats Will Be Able To Do

Winning the elections will allow Democrats to block Trump's bills, limit his budget priorities, and conduct investigations. Control over the Senate will provide the opportunity to not approve his nominees for positions in the administration and courts, including the Supreme Court.

However, the president will retain broad powers in trade, foreign policy, and the management of federal agencies.

Since returning to the White House in January 2025, Trump has already used them to impose broad tariffs, strengthen immigration control, reduce the federal apparatus, and engage in foreign policy actions, including a war against Iran. A significant exception was a large package of tax and budget cuts, which Congress approved in July 2025.

«President Trump has effectively ignored Congress for the past two years and has tried to do as much as possible through presidential decrees and executive powers,» said Nathan Gonzales, editor of the analytical publication Inside Elections.

He expects this practice to continue even with a Democratic majority.

Decisions that exceed the president's legal authority can be blocked by the courts. Therefore, the White House plans to obtain legal opinions from the Department of Justice on what Trump can do independently and how to defend such actions in court.

Officials Are Being Prepared for Investigations

Congressional investigations are an obstacle that cannot be circumvented by presidential decree.

Earlier, Reuters reported that Democrats had discussed hearings, subpoenas for testimony, and document requests to verify whether Trump used power to benefit himself, his allies, or donors.

According to agency sources, White House lawyers are already explaining to department heads how to respond to such requests. They are advised to be cautious about what they record in writing.
